The North East Development Commission (NEDC) has issued a stern warning to the public and corporate entities regarding the unauthorized use of its name, logo, and official identity by unscrupulous individuals and organizations across various digital and print platforms.
In a public disclaimer released by the management on Friday, the commission expressed concern over the activities of entities falsely claiming affiliation with the agency, a move the commission described as a deliberate attempt to deceive unsuspecting members of the public.
The commission declared that the use of its branding, insignia, or identity without prior written authorization is strictly prohibited. It further emphasized that any website, social media account, or publication utilizing its official marks without approval is fraudulent and unauthorized.
Legal Implications
The NEDC warned that such impersonation and misuse of its institutional identity constitute serious violations of Nigerian laws, noting that offenders would face severe legal consequences.
Specifically, the commission highlighted the following legislative frameworks:
- Nigeria Data Protection Act (NDPA), 2023: For unlawful processing, misuse, or misleading representation involving institutional identity, which may attract regulatory sanctions.
- Cybercrimes (Prohibition, Prevention, etc.) Act, 2015: Concerning identity theft, impersonation, and electronic fraud.
- Trade Marks Act, Cap T13 LFN 2004: Which prohibits the unauthorized use of registered marks, including logos and insignia.
Potential Consequences
The commission stated that any individual or organization found engaging in these illicit activities, including the operation of fake online platforms, would be subject to immediate legal action. The potential enforcement measures, according to the NEDC, include:
- Civil litigation for damages.
- Criminal prosecution.
- Regulatory sanctions and penalties under applicable laws.
- Takedown and enforcement actions across digital platforms.
Call for Public Vigilance
The NEDC urged the public to exercise caution and verify all information pertaining to the commission solely through its official communication channels.
“Members of the public are advised to refrain from engaging with unauthorized platforms or individuals claiming affiliation with the Commission and to report suspicious accounts or activities to the appropriate authorities or the Commission,” the statement read.
The management further clarified that it would not accept responsibility for any transactions, representations, losses, or engagements carried out by unauthorized persons or entities using its name or identity.
